FREQUENTLY ASKED QUESTIONS
Real Estate Questions, Answered.
I’m selling property to a family member. Do I need a lawyer? Can’t I just write up my own deed?
Even a “simple deed” can go wrong in a lot of ways, and typically it will be in both parties’ best interests to set up a purchase and sale agreement and obtain title insurance and a properly reviewed deed. If the entire transaction is not cash, you will also need to consider how the balance will be secured, whether through a recorded contract or deed of trust. We can help you make sure both parties are protected—an asset worth hundreds of thousands of dollars deserves the right documents.
I’m selling off part of my land, how should I handle the shared well and driveway?
It’s really important to get proper use agreements in place before the property is sold to maintain clear title and responsibility down the road. If you missed this step and complications are arising, we can help you negotiate a resolution.
What is the difference between a warranty deed and a quitclaim deed?
- A warranty deed guarantees that the seller holds clear, marketable title to the property, has the legal right to transfer it, and will defend the buyer against past title claims. It provides the highest level of buyer protection.
- A quitclaim deed transfers whatever interest the grantor holds in the property without providing any guarantees regarding title quality or ownership rights. It is commonly used between family members, in divorce settlements, or to clear minor title defects.
